 Opera Norway AS and its affiliates offer a number of different services through their respective websites and software. The terms of this document govern your use of those services. Please read this document carefully.
 . **This is a contract.**
 . These Terms of Service ("General Terms"), along with Opera's Privacy Statement, form a legally-binding contract between you and Opera Norway AS (P.O. Box 4214, Nydalen, 0401, Oslo, Norway), as well as its affiliates ("Opera" and "we," "us" and "our"). By using the Services (as defined below), you are agreeing to be legally bound by these General Terms. If you don't agree with these General Terms, you must discontinue using the Services.
 . Opera Account features may be a subject of additional conditions. Please read them carefully before enabling.
 . Opera Account credentials give you access to the Opera features that may be accessed separately.
 . You must provide us with your email address and set up a password to create your Opera Account. You may delete your Opera Account at any time. Please note that in such a case you will lose your access to features that require an Opera Account.
 ### AI Chat Feature

 The AI Chat feature ("AI Chat") is an AI-powered chat assistant that allows you to provide input ('Input') and receive output generated by AI ('Output'). AI Chat is made available in qualifying countries. By enabling and using AI Chat you agree to be bound by these Terms that govern your use of AI Chat. Please read the Terms carefully.
 . **Opera Account gives you access to additional/extended features of AI Chat.** You do not need Opera Account to access and use AI Chat. However, you will need to create or log into Opera Account to gain access to additional or extended features of AI Chat.
 . **Input and Output.** You are the owner and creator of Input. Opera may not grant you any rights to the Output, which in some cases may also be subject to intellectual property rights. Please note that all provisions of Terms referring to 'Content' and 'Third Party Content' are applicable to Input and Output.
+. **We expect you to be a responsible user.** Please act carefully and don't provide AI Chat, either by typing into or attaching to AI Chat chatbox and/or by otherwise using AI Chat, with information like your name, address, or credit card details. Do not use it for any harmful purposes (to third parties or yourself). We strongly discourage asking AI Chat for medical, legal, or financial advice. Carefully review any Output generated by AI Chat and consider it before relying on it or sharing it with others.

 . **Restricted Content and use** You may not (i) use AI Chat for any illegal purpose, to violate or facilitate the violation of any person's rights or any law or regulation, or in any manner inconsistent with the Terms; (ii) generate obscene, vulgar, sexually-oriented, hateful, or threatening Output, generating malware (iii) use AI Chat feature for unauthorized services requiring professional knowledge and/or qualifications (like: providing legal, tax, financial, medical advices) (iv) reverse engineer, de-encrypt, or otherwise derive the design, internal logic, structure or inner workings (including algorithms and source code of AI Chat) (v) use output from the AI Chat to develop models that compete with AI Chat and/or OpenAI and/or Google; (vi) provide AI Chat with information regarding minors under 13 or applicable age for digital consent. You agree to use AI Chat solely for your own personal, noncommercial use and benefit. You may read more in our [FAQ](https://help.opera.com/en/browser-ai-faq/) section.
 . **AI Chat is provided without any warranties or guaranties.** Opera does not represent or warrant that AI Chat will fully and/or correctly execute the task from your Input, nor that the Output will be actually provided and/or will be accurate, mistake-free and adequate to the prompt. Like other AI-powered tools, AI Chat may make mistakes, or fail, or misinterpret your Input. It might provide you with inaccurate or misleading information (commonly referred to as 'hallucinations'), or take actions that are unexpected. Do not use AI Chat if you are not willing to accept the risks associated with the usage and performance of AI - powered capabilities.
 . **You or Opera may terminate this agreement.** You may terminate this Agreement at any moment by deleting your Opera Account. Except as otherwise specified herein, Opera may terminate these Terms at any time on prior notice. Should you violate these Terms or the rights of any third-party intellectual property owner or threaten the operation of AI Chat, Opera may delete your Opera Account and terminate the Terms with you unilaterally, through a notification to your email address.
 . **Effect of Termination.** If your contract with us offered by these Terms discontinues for any reason, then it will cease immediately to have effect (apart from any sections that are necessary for our enforcement of any legal rights and remedies against you). This means that you will no longer have access to AI Chat.
 . **Ceasing to provide the AI Chat.** If we decide to cease to provide the AI Chat, then you will be notified as soon as reasonably possible.
 . **Customer Service.** If you have a question about AI Chat, you may contact customer support [here](https://opera.atlassian.net/servicedesk/customer/portal/52). If you believe that any content accessible via AI Chat infringes your rights, you may submit a notification to customer support.

 ### GX Cloud Feature

 . In order to redeem Opera Points you need to perform qualifying tasks in Opera Mini. Then Opera Points may be redeemed according to applicable prizes;
 . Opera Points you collected will expire 24 months after the moment you earned them;
 . Opera Points are not redeemable if Opera determines in its sole discretion that: (i) you have abused IT systems to perform activities, or affect the integrity, confidentiality, or availability of the Opera Points feature data in any way; (ii) you attempted to circumvent any of the security mechanisms of the Opera Points feature.
 . **You or Opera may terminate this Agreement.** You may terminate this Agreement at any moment by opting out from Opera Rewards Points . Except as otherwise specified herein, Opera may terminate these Terms at any time on prior notice. Should you violate these Terms or threaten the operation of the Opera Rewards Points, Opera may delete your Opera Rewards Points account and terminate these Terms with you unilaterally, through a nin-app notification. Your right to redeem Opera Points will expire upon termination. Termination of these Terms does not affect your use of other Services provided by Opera and the general Terms of Service will still apply to your use of such other Services.
 . **Deleting the Opera Points feature account.** Your Opera Points feature account can be deleted by yourself anytime or automatically after 2 years of inactivity. Please note that after deleting your Opera Rewards Points account: (i) Opera will erase your Opera Rewards Points personal data to the extent permitted by applicable law; (ii) you will lose access to information about your Opera Points; (iii) you may no longer collect and will lose your Opera Points that were not redeemed (even if they were redeemable); and (iv) you will no longer receive any notifications related to the Opera Rewards Points.

+### Crypto Wallet Services

+. Some of Opera's software applications include a non-custodial wallet which provides a self-hosted, user controlled solution based on blockchains and cryptographically secured digital assets. The in-app non-custodial wallet service ("Crypto Wallet Service"), is provided by our affiliate, Blueboard Limited, which is solely responsible for its operation. Use of the Crypto Wallet Service is subject to Blueboard's [Terms of Service](https://minipay.to/terms-of-service) and [Privacy Statement](https://minipay.to/privacy-statement). Some services in the Crypto Wallet Service could be provided by Opera under these Terms, or by third parties under their own separate terms.
+. As explained in Blueboard's Terms of Service, you can only use the Crypto Wallet Service if permitted under the laws of your jurisdiction. Please make sure that your use of the Crypto Wallet Service is in compliance with all laws, rules, and regulations that apply to you. It is your responsibility to determine what, if any, taxes apply to your Cryptocurrency transactions, and it is your responsibility to report and remit the correct tax to the appropriate tax authority where applicable. Neither Opera nor Blueboard is responsible for determining whether taxes apply to your transactions or for collecting, reporting, withholding, or remitting any taxes arising from any of your transactions.
+### Opera eSIM (powered by Holiday.com)

+Please read these Service-Specific Terms (the **"Terms"**) carefully before purchasing or activating Opera eSIM through the Opera browser or any related application. By purchasing, installing, or using an Opera eSIM, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not purchase or activate Opera eSIM.
+If you are a resident of the United States, please carefully review the mandatory arbitration clause in Section 9 below.
+. **Opera eSIM Services:**
+. **Data Only**: Through the eSIM Services we provide digital eSIM cards (powered by [Holiday.com](http://holiday.com/)) that enable cellular data connectivity on compatible devices. These plans are for data use only and **do not include voice calling (telephony) or SMS (text messaging) services**. You can use your eSIM for internet access, data-based apps (like WhatsApp, Skype, iMessage), and online activities while traveling internationally.
+. **Temporary:** eSIM packages are designed as **short-term, temporary travel data plans** for international use. Each package is valid for the duration specified at purchase (e.g., 7 days, 15 days, 30 days) and automatically expires once the data balance is consumed or the validity period ends. No single eSIM package or connection shall remain active or be used for more than **120 consecutive days**.
+. **Prohibition on Permanent Roaming:** You may not use an eSIM package for **permanent roaming** (defined as continuous use in a single destination for 90 days or longer within a 120-day window). We reserve the right to deactivate the eSIM Services that violate this rule.
+. **Device Compatibility:** To use the eSIM Services, you must have an **unlocked, eSIM-compatible device**. A list of compatible devices is available on [https://holiday.com/compatible-devices/](https://holiday.com/compatible-devices/) . The eSIM profile remains on your device even after your data plan expires, unless manually removed.
+. **Purchasing & Activation:** After purchasing a plan, you will receive instructions to download and activate your eSIM. Activation requires a stable internet connection (Wi-Fi or cellular data). Each plan includes details on price, validity period, and supported countries. Plans are tied to the device they are installed on and cannot be transferred. Unused data balance does not roll over after the package validity period expires.
+. **Pricing and Payment:** Pricing is displayed at checkout. All fees are payable at the time of purchase. Taxes are included in the displayed price where applicable.
+. **Cancellations and Refunds:** You have the right to cancel your purchase within **30 days**, provided that **you have not yet installed, downloaded, or activated the eSIM profile**. You may request a refund under the following conditions.
+. **Unused eSIMs:** If you change your mind or your travel plans change, you can receive a **full refund, no questions asked**, provided:
+. You purchased the eSIM directly within the Opera browser or app,
+. The purchase was made within the last **30 days,**
+. The eSIM has **not been activated or used** (zero data consumed).
+. **Incompatible or Carrier-Locked Devices:** If you discover after purchase that your phone is carrier-locked or incompatible with eSIMs, you are eligible for a full refund, provided:
+. You purchased the eSIM directly within the Opera browser or app.
+. The purchase was made within the last **30 days.**
+. The eSIM has **not been used**.
+. **Connection & Technical Issues:** If you experience service failure or poor connectivity caused by our systems or the destination network:
+. You must contact **Opera Customer Support immediately** while experiencing the issue during your trip (if you cannot connect to support, capture screenshots or a screen recording proving the issue).
+. You must describe the problem and provide troubleshooting details to support.
+. If we cannot resolve the issue, you will be eligible for a **full or partial refund**, determined by the amount of data used prior to the issue.
+            _Note: We cannot guarantee a refund if connectivity issues are reported after your trip has ended without prior notification or proof._Refunds may be requested by contacting support at esim@support.opera.com. Refunds are generally processed within thirty days and are made to the original form of payment. Refunds are sent in USD or EUR. For non-USD purchases, the refund amount may differ from the amount originally paid in local currency due to changes in foreign exchange rates or processing charges.
+. **Responsible Usage Policy (Fair Usage & Acceptable Use)
+    **To ensure a consistent and reliable service for all customers, your use of the eSIM Services is subject to the following:
+. **Fair Usage Policy:** Unlimited data plans are subject to a Fair Usage Policy. While there are no strict data caps, customers who exceed **25GB of high-speed data usage within a 30-day billing cycle** may experience reduced data speeds (throttling) during periods of network congestion. Throttled speeds are generally sufficient for basic browsing, messaging, and email. Continued or extreme data usage may be considered misuse and could result in plan restrictions or service suspension.
+. **Acceptable Use:** You agree not to misuse the eSIM Services. A misuse includes, but is not limited to:
+. Sending unsolicited advertisements (spam).
+. Transmitting any content that is illegal, hateful, threatening, or defamatory.
+. Infringing on the intellectual property rights of others.
+. Engaging in any form of hacking or unauthorized access to computing devices.
+. Using the eSIM Services for any unlawful purpose.
+. You agree to use the eSIM Services strictly for personal, lawful travel connectivity. You agree **not** to:
+. Use the service for any illegal, fraudulent, or unauthorized purpose.
+. Resell, share, sublicense, or redistribute the eSIM connection to third parties.
+. Conduct any activity that interferes with, disrupts, or damages the underlying mobile networks or infrastructure.
+. **Consequences of Misuse:** Opera reserves the right to restrict access to the eSIM Services, terminate your Account, or take other legal measures, **without providing a refund for Services already paid**, if we believe at our absolute discretion that you have misused the eSIM Services. You agree to indemnify, defend, and hold harmless Opera, its Partners, officers, directors, employees, and agents from any claims and expenses, including attorneys' fees, arising out of your use of the Services or your violation of this Agreement.
+. **License to Use the eSIM Services:** Subject to your compliance with these Terms, we grant you a worldwide, non-exclusive, non-sublicensable, revocable, and limited license to download and use the eSIM Services. Modifying, distributing to unauthorized parties, reverse engineering, or otherwise using the eSIM Services in any way not expressly authorized is strictly prohibited.
+. **Third-Party Websites and Partner Services:** The eSIM Services may provide links to third-party websites or partner services. Opera is not responsible for the availability, content, or practices of these third parties. Your interactions with any partner services are governed by their own terms and policies, and you use them at your own risk.
+. **Disclaimers and Changes to Services:** The eSIM Services ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM, ON BEHALF OF OPERA AND ITS SUPPLIERS, ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the eSIM Services will be uninterrupted, timely, secure, or error-free. Service coverage, speeds, and quality may vary. We reserve the right to modify, suspend, or terminate the eSIM Services for any reason, at our sole discretion. We will attempt to notify users in advance of material changes.
+. **Limitations of Liability:** TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF the eSIM Services. THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR the eSIM Services DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
+. **Chargebacks:** If you initiate a chargeback with your bank or credit card provider for any valid fees payable to Opera, we reserve the right to immediately suspend your access to the eSIM Services. Initiating a chargeback is a breach of your payment obligations. We may restrict your future access if we believe the chargeback was requested in bad faith.
+. **Dispute Resolution**
+. **For United States Residents: Agreement to Arbitrate:** Any dispute or claim between you and Opera, including any disputes regarding whether a dispute or claim between the parties is arbitrable, shall be exclusively resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its rules. The fees and costs associated with arbitration will be those set forth in AAA applicable fee schedules. To learn more about the AAA Rules and how to begin an arbitration, you may call AAA at 800-778-7879, email AAA at CustomerService@adr.org, or visit AAA's website at www.adr.org. If any claim or remedy is found by a court or arbitrator to be not arbitrable, that claim or remedy shall be severed and brought in court with the remaining claims and remedies arbitrated. Notwithstanding the above, you or Holiday.com may elect to litigate a claim in small claims court if the amount sought is within the jurisdictional limits of that court.
+. **Class Action Waiver and Mass Arbitration Procedure:** YOU AND OPERA MAY NOT BRING CLAIMS AGAINST THE OTHER AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. If more than 25 arbitration demands of a substantially similar nature, are filed against us by the same law firm or collection of legal counsel or law firms, AAA shall (i) group the arbitration demands into batches of no more than 25 demands per group; and (ii) provide for resolution of each group or batch as a consolidated arbitration with one set of filing and administrative fees and a single arbitrator assigned per group or batch. To the extent AAA does not enforce these batching procedures, the parties agree that AAA shall endeavor to assign multiple proceedings to a single, mutually agreeable merits arbitrator consistent with the AAA Mass Arbitration Supplementary Rules.
+. **Informal Resolution:** Before arbitration, you agree to attempt to resolve the dispute informally for 60 days by sending a detailed notice to the following email address: legal@opera.com.
+. **Opt-Out:** You may opt out of this arbitration agreement within 30 days of your purchase or first use of the eSIM Services, whichever is sooner, by sending a written notice with the subject line "ARBITRATION AND CLASS ACTION WAIVER OPT-OUT" to the following email address: [legal@opera.com](mailto:legal@opera.com)
+. **For Non-U.S. Residents:** Any dispute or claim arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of **England and Wales**.
