Personal Data and other Customers' information collected by LiveChat, Inc. is used in order to complete registration (create an Account/License) and at the same time to ensure Customers' access to LiveChat, Inc. 's Services. While registering on one of our websites related to our Services, we request that you provide us with such information as first name, last name, company name, address, website address, e-mail address and credit/payment card information in the event when a Customer continues to use our Services after free of charge trial period. Unless the Customer decides to use our Services after a free trial period, credit/payment card information is not required. We also collect other information (including Personal Data) provided by Customer while using our Services. Some of the provided information such as an IP address, domain, browser type, operating system type, etc. may be automatically acquired when a user visits our websites. When contacting LiveChat, Inc. the Customer may be requested to render accessible analogical data to those provided while registering on our website. We may also collect information (including Personal Data) provided by Customer and related to Customer's Agents (people employed to operate the Service), and End-users Personal Data provided in a Pre-chat survey. We also store the chat content. Please note that as you insert data (including Personal Data) through the Service to the system, you are fully responsible for lawfully obtaining such data in accordance with the applicable law, as well as a lawful processing of such data to LiveChat, Inc. Details of your liability for the aforementioned data you can find in Terms of Use. If the applicable law requires you to inform your End-Users about the use of our Services and/or to collect from them the required consents from them, you are obliged to perform it on your own.

The Customer hereby agrees and warrants that the processing, including the transfer of its Personal Data (including the Personal Data provided to the Company's system through the Customer's Account), has been and will continue to be carried out in accordance with the relevant provisions of the applicable Data Protection Laws (and, where applicable, has been notified to the relevant authorities of the Member State where the Company is established or has its representative) and does not violate the relevant provisions of that Member State.

By using our Services the Customer gives its consent to the profiling of Personal Data that was given to the Provider, for the purpose of proper maintenance and providing the Service to the Customer. The Customer agrees that the profiling of the Personal Data shall serve, in particular, the purpose of providing the Customer with content that is accurate and consistent with the scope of the Service used by the Customer. The Customer acknowledges that it has the right not to be profiled. In such cases the request can be made at any time at [support@livechat.com](mailto:support@livechat.com). The Parties undertake reasonable steps and efforts to eliminate profiling however in case of withdrawing the consent, the Customer is aware and acknowledges that it is tantamount to the lack of possibility to provide the Services. Withdrawing the consent is tantamount to the termination of the Agreement.
553.2. Registration Data. LiveChat, Inc. receives the necessary details (including Personal Data and other Customers' information) in order to complete your registration on our Website. This ensures you have access to the Engagements you have subscribed to, e.g. first name, last name, company name, address, website address, e-mail address and credit/payment card information for Customers deciding to move beyond the free Services, otherwise, credit/payment card information is not required). In addition to the above, We also collect other types of information (including Personal Data) depending on how you use our Engagements. When reaching out to LiveChat, Inc., the Customer might be asked to provide similar data to what they had given during the registration process on our Website.

613.5. Customer Responsibilities Regarding Personal Data. Customer is solely responsible for the processing of Personal Data (including but not limited to its transfer) in accordance with the relevant data privacy law, including obtaining necessary consents or having other valid legal grounds for processing. Customer must obtain all necessary permissions and consents as may be required by any relevant data privacy law when collecting, storing, processing and transferring Personal Data via LiveChat and its Sub-Processors. Customer ensures the accuracy, quality, and legality of Personal Data and the means by which Customer acquired them. Instructions given by Customer for Personal Data Processing must comply with relevant data protection laws. In addition, as a data controller, Customer shall (a) as required by applicable law, provide notice to its End-Users and Agents, as well as obtain their consent (if required) or have other legal basis for processing and transferring their personal data to LiveChat and its Sub-Processors in line with Data Processing Addendum ("DPA").

695.1.10. Retention of Copies. The Company may retain Personal Data to the extent required by applicable law and only to the extent and for such period as required by such laws and always provided that the Company shall ensure the confidentiality of all such Customer Personal Data and shall ensure that such Personal Data is only processed as necessary for the purpose(s) specified in such law requiring its storage and for no other purpose. The Customer agrees that after the termination or expiration of the Agreement its data may be stored as a backup for the time needed to secure (establish, investigate or defend) Customer's and Company's claims that may arise due to the performance of the Services (for the time it takes for the claims to be barred).
693.9. Communication. By participating in the Engagements, you agree to be contacted by us to receive electronic communications regarding your interactions with Engagements. You may opt-out of receiving these types of communications by adjusting the device settings anytime. Users who leave their contact details while accessing particular sections of our Website might receive additional messages not described above.

735.2. Geo-Location data. Please be aware LiveChat, Inc. may have access to your geo-location data as we collect and process IP addresses of all devices you use LiveChat, Inc.'s software on. Collecting and processing your geo-location data refers to mobile devices as well as computers. It happens regardless you are a Visitor or a Customer.
733.11.Customer's Agents and End-Users data: LiveChat may process data of Customer's Agents (individuals operating the Services) and Customer's End-Users (individuals contacting you via the Services or interacting with your website integrated with or utilizing our Services) to facilitate your operation of the Account and service provision to End-Users. This information will be treated in line with the Agreement. The type of information (including Personal Data) We may receive include a first name, last name, e-mail address, other contact details, chat content data and potentially other information (e.g., profile picture, network, username, user ID, age range, language, country). As such, LiveChat requests all its Customers to inform their users of our Services's integration and, where necessary, to obtain any necessary permissions which Customer is obliged to perform on its own. Note that when End-Users interact with you using our Services and/or visit other sites integrated or utilizing the Services, your privacy policy governs the information collected instead of this Privacy Policy. However, this Privacy Policy does not apply to the services that our Customers provide to their End-Users. They have their own policies about the collection, use, and disclosure of the personal information of their End-Users.

You may opt-out of receiving these types of communications by turning off push notifications at the device level. We may also send you some emails from our blog.
